These terms set the ground rules for using the Howetek Creative website and engaging us for creative, design, development, or related digital services.

01 / Agreement to these terms
By using this website, you agree to these Terms of Service. If you contact Howetek Creative or engage us for services, these terms apply together with any written proposal, statement of work, or other agreement that we accept for your project.
If a signed project agreement conflicts with these website terms, the signed project agreement controls for that project.
02 / Our services
Howetek Creative provides creative direction, brand identity, web design, development, hosting coordination, and related digital services. The exact deliverables, timeline, fees, and acceptance criteria for a project will be described in the applicable proposal or statement of work.
We may refine our services, tools, and processes over time. We will communicate material changes that affect an active project.
03 / Client responsibilities
Clients are responsible for providing accurate information, timely feedback, required approvals, access to necessary accounts, and content or assets they want included in a project. Delays in these responsibilities may affect the timeline and fees.
You represent that you have the rights and permissions needed for any text, images, trademarks, data, or other materials you provide to us.
04 / Fees and payment
Project fees, deposits, payment milestones, expenses, and applicable taxes will be stated in the applicable project agreement. Invoices are due according to those terms.
We may pause work when an undisputed invoice is overdue. A pause may change the project schedule and does not waive amounts already due.
05 / Intellectual property
Unless a project agreement says otherwise, Howetek Creative retains ownership of its pre-existing tools, methods, templates, concepts, and reusable code. Client-provided materials remain the client's responsibility and ownership.
Once all amounts due for a project are paid, the client receives the rights to the final deliverables described in the applicable agreement. Unused concepts, drafts, working files, and third-party materials are not transferred unless expressly included.
Unless the project agreement says otherwise, Howetek Creative may display completed work in its portfolio and marketing materials. We will respect reasonable confidentiality requests.
06 / Third-party tools and services
A project may use third-party platforms, hosting providers, plugins, fonts, APIs, or other services. Those services have their own terms, availability, fees, and privacy practices. We are not responsible for changes or outages caused by a third-party provider.
07 / Acceptable use
You may not use this website to violate laws, infringe another person's rights, transmit malicious code, interfere with the website, or submit content that is fraudulent, harmful, or unlawful.
We may restrict or suspend access to the website when necessary to protect the site, our users, or our business.
08 / Disclaimers
The website and its content are provided for general information and are made available on an as-is and as-available basis. We work to keep information accurate and the website available, but we do not guarantee that every page will always be complete, current, secure, or uninterrupted.
Project-specific warranties, if any, must be stated in the applicable project agreement.
09 / Limitation of liability
To the fullest extent permitted by law, Howetek Creative will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunity, arising from website use or a project.
To the fullest extent permitted by law, Howetek Creative's total liability for a project will not exceed the fees paid to Howetek Creative for that project during the six months before the event giving rise to the claim.
10 / Termination and changes
Either party may end a project as allowed by the applicable project agreement. On termination, the client remains responsible for approved work, committed expenses, and other amounts due through the termination date.
We may update these website terms from time to time. The effective date above identifies the current version. Terms for an active project remain governed by the project agreement unless both parties agree otherwise.
